Overview. This Banfield Pet Hospital^® 70th Anniversary Giveaway (the “Promotion”) is a promotion sponsored by Medical Management International, Inc., doing business as Banfield Pet Hospital (“Banfield”), 18101 SE 6th Way, Vancouver, WA 98683.

Eligibility. Only legal residents of the 50 United States and D.C., 18 years of age or older are eligible to enter the Promotion. The following persons are not eligible to enter the Promotion: employees, agents, officers, directors (and the members of the immediate families and/or persons living in the same household as such individuals) of Banfield or its affiliated companies, subsidiaries, veterinarians, suppliers, vendors, representatives, distributors, advertising agencies, promotional suppliers, and their respective parent companies (“Banfield Affiliates”). Void where prohibited by law.

Entry Period. The entry period for this Promotion begins on May 14, 2025 at 12:01AM PDT and ends on May 20, 2025 at 11:59PM PDT (“Entry Period”). Banfield’s computer, or its third-party service provider’s computer, is the official timekeeping device for the Promotion. Banfield may cancel the Promotion at any time.

How to Enter. To enter you must have a valid, public Instagram account and complete all the following steps during the Entry Period:

Follow Banfield’s Instagram account (@banfieldpethospital);
Like Banfield’s Instagram post that invites entries into the Promotion (“Invitation Post”); and
Comment on the Invitation Post, respond to the prompt, and Tag a friend in your response.

By successfully completing the foregoing during the Entry Period you will be entered into the Promotion (each an “Entry” and collectively, the “Entries”). Each Entry will have an equal chance of winning a prize. Only one Winner per household. Entries must be submitted, and remain publicly posted, during the Entry Period to be eligible for the Promotion.

Banfield is not responsible for Entries not received or posted due to lost, failed, delayed, or interrupted connections or miscommunications, or other electronic malfunctions. Banfield is not responsible for incorrect or inaccurate Entry information, whether caused by any of the equipment or programming associated with or utilized in the Promotion, or by any human error which may occur in the processing of Entries. Instagram entrants must be the authorized Instagram account holder. Entries containing false or fraudulent information, or that do not comply with these Official Rules, will be disqualified. Entries remain the property of Banfield and will not be returned or acknowledged.

Each Entry is bound by and subject to the terms of these Official Rules and, as applicable, Banfield’s Privacy Policy (located at www.banfield.com/privacy) and Banfield’s Website Terms (located at www.banfield.com/terms).

Entry Restrictions. Entries must not: (a) violate any third party rights, including, but not limited to, copyrights, trademark rights, or rights of privacy and publicity; (b) contain defamatory statements; (c) include threats to any person, place, business, or group; (d) be obscene or indecent; or (e) demonstrate or display harm to animals, or other inappropriate behavior in Banfield’s sole discretion. Any elements that appear in the Entry, including, without limitation, images, text, or other materials used must be entirely original and created by the entrant, or be in the public domain. Use of any elements that are not original or in the public domain will result in disqualification of an Entry in Banfield’s sole discretion.

Drawing and Notification. Banfield will select up to seven (7) winners through a random drawing (each a “Winner” and collectively, the “Winners”), on or about May 21, 2025, from all eligible Entries received during the Entry Period. The final Winner chosen in the random drawing will be the “Grand Prize Winner.” The odds of winning a prize depend on the number of Entries received during the Entry Period. The results of all drawings, and the decisions of Banfield, are final and binding in all respects. Potential Winners will be notified by direct message to the Instagram account used for the Entry. If a potential Winner does not respond to Banfield within three (3) days of the potential Winner notification, or if he/she is found to be ineligible, or if he/she cannot or does not otherwise comply with these Official Rules, an alternate Winner may be selected by a second chance random drawing.

Prizes. Seven (7) total prizes will be awarded, including: six (6) regular Winners that will each receive one (1) $50.00 PetSmart^® Gift Card (approximate retail value: $50.00); and one (1) Grand Prize Winner that will receive one (1) $500.00 PetSmart^® Gift Card (approximate retail value: $500.00).

Prize limit; no substitution; non-transferrable. The right to receive a prize is non-assignable and non-transferable and no prize substitution or exchange or cash equivalent will be allowed except by Banfield, who reserves the right to substitute a prize (or portion of a prize) in case of unavailability of a prize or force majeure. In the Banfield’s sole discretion, some or all of the prizes may not be awarded.

License. By submitting an Entry, you: (a) irrevocably grant to Banfield and all Banfield Affiliates the unconditional and perpetual non-exclusive right, license and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, repost, reshare, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Entry as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude Banfield’s use of your Entry, or require any further permission for Banfield to use the Entry; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Banfield on the grounds that any use of the Entry, or any derivative works, infringes any of your rights as creator of the Entry, including, without limitation, copyrights, trademark rights, and moral rights. Banfield has the right, but not the obligation, to use any Entry as described herein.

Each Winner’s Entry into the Promotion and/or acceptance of a prize constitutes permission for Banfield and each Banfield Affiliate to use the Winner’s name, address (city and state) and/or likeness for advertising and trade purposes without further compensation, worldwide and in perpetuity, in any and all forms of media, now known and hereafter devised, including, without limitation, on-line and Instagram, unless prohibited by law.

General Conditions. All taxes are the sole responsibility of Winners. Winners may be required to execute (and have notarized) an Affidavit of Eligibility, a Liability Release, and/or a Publicity Release (collectively “Affidavit/Release”) which must be returned to and received by Banfield within 10 days from Winner’s receipt of the Affidavit/Release. Any failure to comply with the foregoing may result in disqualification and an alternate Winner may be chosen. Return of the prize, the prize notification, or the Affidavit/Release as undeliverable may result in disqualification and an alternate Winner may be selected. All entrants agree to comply with these Official Rules. Any person attempting to defraud or in any way tamper with this Promotion, and any person who does not comply with these Official Rules, will be ineligible for prizes and may be prosecuted to the full extent of the law.

THE WASHINGTON COURTS (STATE AND FEDERAL) WILL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE PROMOTION AND THE LAWS OF THE STATE OF WASHINGTON WILL GOVERN THE PROMOTION. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.

If, for reasons beyond Banfield’s control, the Promotion is not capable of running as originally planned, Banfield reserves the right in its sole discretion to suspend, cancel or modify the Promotion, without liability. Banfield is not responsible for errors, failures or delays caused by Banfield’s or any entrant’s computer system, hardware, or software.

Waivers and Disclaimers. BY ENTERING THE PROMOTION, EACH ENTRANT AGREES TO WAIVE, ANY AND ALL CLAIMS OR CAUSES OF ACTION AGAINST BANFIELD AND BANFIELD AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS FOR LOSSES, DAMAGES, OR INJURIES OF ANY KIND THAT MAY OCCUR, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM PARTICIPATION IN THE PROMOTION, OR RECEIPT OR USE OF THE PROMOTION PRIZES (OR ANY PORTION THEREOF), OR ANY TRAVEL OR ACTIVITY RELATED THERETO. NO WARRANTY. EVERYTHING REGARDING THIS PROMOTION, INCLUDING THE WEBSITES AND THE PROMOTION PRIZE(S), ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.

The Promotion is not endorsed, sponsored or administered by Instagram. Instagram is not associated with the Promotion. By entering the Promotion, you hereby release Instagram from all responsibility and liability associated with the Promotion. All information submitted via the Instagram platform is subject to Instagram’s privacy policy and Instagram’s Terms of Use, available at help.instagram.com. Any questions, comments or complaints regarding the method(s) of entering this Promotion must be addressed to Banfield and not to Instagram.
